O3 Drive Driver — Terms of Service

These terms govern your use of the O3 Drive Driver app and your provision of transport services arranged through the O3 Drive platform. By signing in and going online, you accept them.
What the driver app collects about you is set out separately in the Driver Privacy Policy.
1) Eligibility
- You must be at least 18 years old.
- You must hold a valid Nigerian driver's licence and any permit required to carry passengers for hire in your area of operation.
- You must keep your licence and any required documentation valid for as long as you drive with us, and provide updated copies on request.
- Driver accounts are created and approved by O3 Drive. You may not transfer or share your account with anyone else — the person driving must be the person signed in.
2) Your relationship with O3 Drive
You provide transport services as an independent operator, not as an employee of O3 Drive. Nothing in these terms creates an employment, partnership or agency relationship. You are responsible for your own tax obligations arising from your earnings.
O3 Drive operates the platform, arranges bookings, sets the applicable fares, and handles payment from passengers.
3) Vehicle assignment
Your vehicle and its plate number are assigned to you by authorised O3 Drive staff and cannot be set or changed from the driver app. This guarantees that the vehicle shown to a passenger is the vehicle that actually collects them. If your assigned vehicle is incorrect, contact support before going online — do not accept trips in a vehicle other than the one assigned to you.
You must ensure the vehicle you drive is:
- Roadworthy, clean and mechanically sound.
- Covered by valid insurance and any registration or inspection required by law.
- Operated in accordance with all applicable traffic laws.
4) Going online and receiving requests
- You choose when to go online. You are under no obligation to be online for any minimum period.
- While online, the app shares your location so requests can be ranked by proximity and passengers can be shown an accurate arrival estimate. Going online means agreeing to this for as long as you remain online.
- You must have notifications enabled to receive ride requests reliably. Without them, requests reach you only while the app is open on screen and you will miss work.
- If your app stops reporting activity for an extended period, the system will mark you offline automatically so requests are not sent to a driver who cannot answer.
- You may offer to take an open request. The passenger chooses which driver to accept, so offering does not guarantee the trip.
5) Conducting a trip
- Travel to the pickup point promptly once assigned, and contact the passenger if you cannot locate them.
- Keep trip status up to date in the app — arriving, starting the trip, and reaching the destination. Fares are calculated from these timestamps, so inaccurate updates affect what the passenger is charged.
- Take a reasonable route to the destination. Do not extend a trip unnecessarily.
- Do not carry more passengers than the vehicle is licensed and insured for.
- Do not request or accept cash payment for a trip booked through the platform, or ask a passenger to settle outside the app.
- Do not cancel trips excessively after accepting them. Repeated cancellation may lead to removal from the platform.
6) Conduct and safety
You must not:
- Drive under the influence of alcohol, drugs or any substance that impairs your ability to drive.
- Use a handheld phone while driving.
- Behave abusively, threateningly, harassingly or discriminatorily toward a passenger, escort or member of staff.
- Refuse a passenger on the basis of race, religion, ethnicity, gender, disability or any other protected characteristic.
- Contact a passenger after a trip for any purpose other than returning lost property.
- Use passenger information for anything other than completing the assigned trip.
- Carry unauthorised persons while online and on a trip.
Any conduct that puts a passenger's safety at risk may result in immediate and permanent removal from the platform, and may be reported to the authorities.
7) Fares and earnings
- Fares are set by O3 Drive and calculated partly from the actual trip duration recorded in the app, together with the rate applicable to your vehicle category. All amounts are in Nigerian Naira (NGN).
- Passengers pay O3 Drive through the app — from their wallet balance or by card. You do not collect payment directly.
- Your earnings are calculated from completed trips and settled according to the payment arrangement agreed with you.
- O3 Drive may adjust or withhold payment for a trip where there is credible evidence of fraud, a manipulated trip record, or a substantiated passenger complaint. We will tell you why.
8) Ratings and quality
Passengers may rate and review you after a trip. Ratings and complaints are used to monitor service quality. Persistently low ratings, or a serious substantiated complaint, may result in suspension or removal from the platform.
9) Lost property
If a passenger leaves property in your vehicle, contact support promptly so it can be returned. Do not keep, use or dispose of items left behind.
10) Service area and availability
O3 Drive operates in and around Osogbo, Osun State, Nigeria. Requests are only dispatched within the serviceable area. We aim to keep the platform available at all times but do not guarantee uninterrupted service — maintenance, network problems or matters outside our control may interrupt dispatch.
11) Suspension and termination
We may suspend or terminate your driver account if you breach these terms, if your licence or required documentation lapses, if we reasonably suspect fraud or manipulation of trip records, or if your conduct puts someone's safety at risk. Where circumstances allow, we will tell you the reason and give you an opportunity to respond.
You may stop driving with O3 Drive at any time by contacting support. Earnings owed for completed trips remain payable, and we may retain trip and payment records the law requires us to keep.
12) Liability
To the extent permitted by Nigerian law, O3 Drive is not liable for indirect or consequential loss, including lost earnings arising from platform downtime, dispatch interruption, or account suspension made in good faith. Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded.
You are responsible for your vehicle, your driving, and compliance with the law while carrying passengers.
13) Changes to these terms
We may update these terms as the platform changes. The date at the top shows when they were last revised. Material changes will be notified in the app or by email before they take effect, and continuing to drive with us after that constitutes acceptance.
14) Governing law
These terms are governed by the laws of the Federal Republic of Nigeria, and the Nigerian courts have jurisdiction over any dispute arising from them.
